We may store, collect, process and use your data in countries other than Republic of India but under compliance with applicable laws. 4.      USER’S RIGHTS

9.      CONSEQUENCES OF BREACH AND INDEMNIFICATION

9.1.   The Company shall be entitled to immediately suspend/terminate the Services being provided to you if any of the terms of the Policy is breached by you.

9.2.   In the event of breach of the Policy, you shall be liable to pay liquidated damages along with costs of recovery of the damages to the Company. You shall be further liable to compensate the Company for the losses incurred by the Company due to the breach of Policy by you and all legal expenses incurred.

9.3.    You agree to defend, indemnify and hold harmless the Company, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from breach of any of the terms of the Policy.

10.2.                  Notwithstanding anything contained in this Policy or elsewhere, the Company shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below).

10.3.                  A Force Majeure Event shall mean any event that is beyond the reasonable control of the Company and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption (provided beyond reasonable control of Snapdeal), power or electricity failure or unavailability of adequate power or electricity.

10.4.                  While We will endeavour to take all reasonable and appropriate steps to keep secure any Personal Information which We hold about You and prevent unauthorized access, You acknowledge that the internet or computer networks are not fully secure and that We cannot provide an absolute assurance regarding the security of Your Personal Information.
